Terms of Service
These Terms govern adult educator accounts and subscriptions for Ready, Set, Seat!, a service operated from New Jersey. By creating an account or using the service, you agree to these Terms and the Privacy Notice.
1. Eligibility and authority
You must be at least 18 and an authorized educator or school staff member using the service for legitimate educational work. Students and other minors may not create accounts. You represent that you have authority to accept these Terms and enter any classroom information you provide.
Your school or district may require approval, a data-processing agreement, or a security review. You are responsible for following those requirements before entering student information or enabling cloud sync.
2. Accounts and security
Provide an accurate adult email address and keep access credentials secure. Native accounts must verify control of that address and may use email password recovery. Google accounts use Google authentication and recovery. Do not share an account or allow students to use it.
Tell us promptly at Braycup123@gmail.com if you suspect unauthorized access. We may suspend access when reasonably necessary to protect users, schools, the service, or comply with law.
3. License and acceptable use
We grant you a limited, non-exclusive, non-transferable, revocable right to use the service for classroom and school planning while your account remains active. You may not resell the service, bypass plan restrictions, probe or disrupt security, upload malware, scrape accounts, reverse engineer except where law permits, or use the service unlawfully.
Do not enter IEP content, disability or health information, grades, student IDs, contact information, photos, free-text behavior notes, or explanations of seating decisions. Supported student records are limited to display names, random internal identifiers, and structured placement or keep-together/separate choices. Do not place student information in the teacher-feedback box or support emails.
4. Classroom content
You or the applicable school retain ownership of classroom content. You give us a limited permission to process that content only to operate, secure, support, synchronize, back up, or delete the service as you direct and as described in the Privacy Notice. We do not sell classroom content, use it for advertising, create commercial student profiles, or use it to train AI models.
Browser workspaces and downloaded backups remain under your device and storage controls. Exports, printouts, and clipboard images may be student records and should be handled through school-approved systems.
5. Free and Pro plans
Free includes multiple classes, browser autosave, portable backups, presentations, groups, and export tools within the published product limits. Pro adds structured seating preferences, keep-together/separate rules, advanced shuffle choices, optional cloud backup, and multi-device synchronization.
Trial and automatic renewal: A teacher's first Pro subscription includes a 30-day free trial. Unless canceled before the trial ends, the selected plan begins at $3 USD each month or $25 USD each year and automatically renews for the same period until canceled. Returning subscribers are not eligible for another trial. Applicable taxes may be added at checkout.
Cancel online through Plan details → Manage billing before the trial end or renewal date. Cancellation stops future renewals; Pro normally remains available through the trial or paid-through date. After Pro ends, browser saving and exports continue on Free, new cloud writes stop, and the existing cloud copy remains available for recovery or deletion.
Payments are generally non-refundable except where required by law. Contact Braycup123@gmail.com promptly about duplicate, unauthorized, or incorrect charges. We will provide at least 30 days’ notice before a price change affects a future renewal.
6. Stripe and other providers
Stripe processes checkout, recurring payments, receipts, and subscription management under its own terms and privacy notice. We do not receive full card or bank details. Cloudflare hosts the service and optional cloud workspace; Google processes Google sign-in; and the transactional email provider processes recovery, security, and deletion messages.
7. School privacy responsibilities
The service is designed to support data-minimizing school workflows, but no product feature alone establishes FERPA, COPPA, state-law, contractual, or district-policy compliance. Schools determine whether use is authorized, whether seating information is an education record, which notices or consents apply, who may access it, and how long copies should be retained.
We remain responsible for our own commitments: limiting use to the educational service, protecting the service, restricting provider access to necessary operations, honoring available access and deletion controls, and offering reasonable school review or data-processing terms on request.
8. Availability, backups, and changes
We work to keep the service dependable, but uninterrupted availability and recovery of every browser, file, or cloud copy cannot be guaranteed. Keep a portable backup when the classroom workspace is important. We may improve, modify, or discontinue features; material reductions to paid functionality will be communicated when reasonably practical.
9. Account deletion and termination
You can request account deletion from Account settings. The emailed confirmation link must be opened within 60 minutes in the same signed-in browser that requested it. Confirming deletion cancels active Stripe subscriptions, removes the adult account, and replaces active cloud classroom content with a content-free deletion marker. It cannot erase copies in browsers, downloads, printouts, clipboard history, or third-party services you selected.
We may terminate an account for material or repeated breach, unlawful use, threats to the service, or legal necessity. When practical, we will provide notice and an opportunity to export authorized classroom content first.
10. Disclaimers and liability
To the fullest extent permitted by law, the service is provided “as is” and “as available,” without implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, loss of data, or lost profits. Our aggregate liability arising from the service will not exceed the amount you paid us during the 12 months before the event giving rise to the claim. These limits do not apply where prohibited or to liability that cannot legally be limited.
11. Indemnity
To the extent permitted by law and your school’s rules, you agree to defend and indemnify us from third-party claims resulting from unlawful use, content you were not authorized to provide, or material violation of these Terms. This does not require indemnification for our own negligence, willful misconduct, or legal duties.
12. Governing law and disputes
These Terms are governed by the laws of New Jersey, without regard to conflict-of-law rules. Courts located in New Jersey will have jurisdiction, except where consumer law permits another forum. Before filing a claim, contact us and allow 30 days for an informal resolution. Nothing here limits rights to report concerns to a regulator or seek relief that cannot be waived.
13. Changes and general terms
We may update these Terms for legal, security, operational, or product reasons. Material changes will be posted with a new effective date and, when appropriate, communicated by email or in the service before they take effect. Continued use after the effective date means acceptance where permitted by law.
These Terms and the Privacy Notice are the entire agreement for individual teacher use. If one provision is unenforceable, the rest remains effective. Failure to enforce a provision is not a waiver. You may not assign your account; we may assign these Terms as part of a merger, acquisition, or transfer of the service, subject to the Privacy Notice.
14. Contact
Questions about these Terms, billing, cancellation, privacy, security, or school agreements may be sent to Braycup123@gmail.com. Do not email rosters, charts, classroom backup files, or exported student information.
